Novant Health Settles $6.6 Million Lawsuit Over Privacy Breach

Advertisment

In a significant development in the healthcare sector, North Carolina-based Novant Health has agreed to pay $6.6 million in a settlement over allegations of breaching Health Insurance Portability and Accountability Act (HIPAA) standards. This settlement is a result of a lawsuit claiming that Novant Health used a tracking pixel on its MyChart portal, gathering information on user interactions for marketing purposes. The tracking pixel allegedly shared personal medical data with technology companies, thereby infringing on privacy regulations.

The Tracking Pixel Controversy

A tracking pixel is a graphic with dimensions of 1x1 pixels that is loaded when a user visits a website or opens an email. It is used to track certain user activities, such as email open rates, visits to a website, or conversions. In this case, the lawsuit claimed that Novant Health used this pixel to collect and share personal information from its MyChart portal, a clear violation of HIPAA standards designed to protect the privacy of health information.

Notably, other major health systems such as WakeMed, Duke University Hospital, and UNC Health were also found to be using similar tracking pixels. While WakeMed and Duke University Hospital are still entangled in lawsuits over the data collected, UNC Health clarified that they were not involved in any lawsuits related to the Meta Pixel and never used it with authenticated data where patient information is stored.

Novant Health's Response

Despite the settlement, Novant Health maintains that it did not commit any wrongdoing. The health system stated that the proposed settlement is not an admission of guilt and emphasized that the court did not find any wrongdoing on their part. It is important to note that settlements often allow organizations to avoid admitting guilt while eliminating the risk of a potentially larger judgment in case of a trial.

Novant Health has also publicly reiterated its commitment to privacy and transparency, which is vital in maintaining patient trust. As healthcare increasingly moves to digital platforms, the protection of patient data will continue to be paramount. This case serves as a stark reminder for healthcare providers to adhere strictly to privacy laws and regulations, particularly when integrating new technologies into their operations.

Eligibility for Potential Class Members

As part of the settlement, individuals who accessed the MyChart portal or Novant's website from May 1, 2020, to August 12, 2022, could qualify as potential class members. This means they may be eligible to benefit from the settlement. However, the exact terms of the payout and the process to claim it will likely be determined as the lawsuit concludes.

The Novant Health settlement underscores the increasing importance of digital privacy in healthcare and the consequences organizations may face for not adequately protecting user data. As technology continues to evolve, healthcare providers must ensure they are not only providing effective patient care but also safeguarding personal information in compliance with existing laws and standards.
